Since recent changes to Portland City Code Chapter 24.55 Building Demolition went into effect April 20, 2015, the Bureau of Development Services has implemented the requirement of a 35-day delay and/or notification prior to issuing permits for demolitions and major alterations and additions to non-accessory residential structures with a residential Comprehensive Plan Map designation.
Effective May 17, 2016, BDS will apply the neighborhood notification and delay provisions to all non-accessory structures with one or more residential units (including multi-family and mixed-use structures) with a residential Comprehensive Plan Map designation. Previously, BDS only applied these provisions to single-family dwellings and duplexes.
This change to the applicability of the delay and/or notification requirements is based on the definition of residential structure in the Portland City Code (PCC), which is not restricted to single-family dwellings and duplexes. (See PCC 24.15.140.) The Code applies to all residential structures with a residential Comprehensive Plan Map designation. (PCC 24.55.200(B) and 24.55.210(B).)
