On May 4, 2016, the City Council passed an Ordinance 187711 ensuring that “unranked” properties listed on the Historic Resource Inventory (HRI) are not exempt from the residential demolition delay provisions of City Code.
Under the previous version of the Demolition Delay Ordinance, it was possible for a property on the HRI to be exempt from the demolition delay provisions of both the Demolition Delay Ordinance (Chapter 24.55) and the Historic Resource Protection Overlay Zone of the Zoning Code (Title 33, Chapter 33.445). Demolition permit applications for properties with a residential Comprehensive Plan Map designation must now meet the requirements of Title 24 for the 35-day demo delay, but are still exempt from the 120-day demo delay required by Title 33. The ordinance does not add new requirements or have any direct impact on how properties are listed or de-listed on the HRI.
